先日、ある中国人の女性から「日本人の夫が亡くなった」というご連絡をいただきました。

人生の伴侶（はんりょ）がお亡くなりになることは、とても悲しいことです。
しかし、悲しみの後には、特に海外で育った方にとっては難しい「相続（そうぞく）」という問題が待っています。

この記事では、まず知っておくべき基本をわかりやすく解説します。

Recently, I received a message from a Chinese woman whose Japanese husband had passed away. Losing a life partner is incredibly sad. However, after the grieving, a difficult issue called “inheritance” awaits, which can be especially hard for those raised abroad. In this article, I will explain the basics you need to know in a simple way.

前几天，我接到了一位中国女性的联系，她的日籍丈夫去世了。 失去人生伴侣是非常令人悲伤的事情。 但是，悲伤过后，还要面临“继承”的问题，这对在海外长大的人来说尤其困难。 在这篇文章中，我将通俗易懂地解说首先需要了解的基础知识。

相続（そうぞく）とは何ですか？/ What is Inheritance? / 什么是继承？

人が亡くなったときに、その人のお金や家などを、家族が引きつぐことです。

注意点： お金などのプラスの財産だけでなく、借金（ローン）も引き継ぐことになります。

Inheritance means that when a person dies, their family takes over their money, house, and other assets. Important: You inherit not only positive assets like money but also debts (loans).

继承（相続）是指：人去世以后，他名下的财产，由家人来继承。 注意： 继承的不只是存款、房子，债务（贷款）也可能一起继承。

誰が相続できますか？ / Who can inherit? / 谁可以继承？

配偶者（妻や夫）は、必ず相続人になります。

【大切なお知らせ】
日本の法律では、役所に結婚の届け出をしていること（法律上の夫婦）が必要です。
残念ながら、一緒に住んでいるだけ（事実婚）のパートナーは、相続することができません。

The spouse (wife or husband) always becomes an heir.

[Important Note]
Under Japanese law, you must be legally registered as a married couple. Unfortunately, partners who only live together (common-law marriage) cannot inherit.

配偶（妻子或丈夫）一定是继承人。

【重要提示】
根据日本法律，必须是办理了结婚登记的“法律上的夫妻”。 很遗憾，仅在一起生活（事实婚姻）的伴侣是无法继承的。

それ以外の家族には順位があります。
For other family members, there is an order of priority.
其他家人有顺序：

1. 子ども （第一順位） Children (1st Priority) 孩子 （第一顺位）
2. 親 （子どもがいない場合） Parents (If there are no children) 父母 （没有孩子的情况）
3. 兄弟・姉妹 （親もいない場合） Brothers/Sisters (If there are no parents either) 兄弟姐妹 （父母也没有的情况）

遺言書（ゆいごんしょ）がある場合 / If there is a Will / 有遗嘱的情况

亡くなった人が遺言書を書いていた場合、原則としてその内容が一番大切になります。

「お金は妻にあげる」「家は長男にあげる」といった指定が優先されます。

If the deceased left a will, in principle, its contents are the most important. Instructions such as “give the money to my wife” or “give the house to my eldest son” take priority.

如果去世的人留下了遗嘱，一般来说，遗嘱内容最优先。 遗嘱里可以写：钱给谁、房子给谁。

銀行のお金はどうなりますか？ / What happens to the bank account? / 银行里的钱怎么办？

人が亡くなると、銀行の口座は止められます（凍結）。
すぐには引き出せません。

銀行が勝手にお金を取ることはありませんが、家族全員の書類がそろってから手続きをする必要があります。

When a person dies, their bank accounts are stopped (frozen).
You cannot withdraw money immediately.

The bank will not take the money, but you need to gather documents from all heirs to process the withdrawal.

人在日本去世后，银行账户一般会被冻结。
不能马上取出来。

银行不会没收钱。需要继承人的材料，才能办理手续。

3ヶ月以内のルール（重要！） / The 3-Month Rule (Important!) / 3个月以内的规则（重要！）

相続が発生してから3ヶ月以内に、どうするかを決める必要があります。

借金が多すぎる場合などは、「相続放棄（そうぞくほうき）」といって、すべて断ることもできます。

You must decide what to do within 3 months of the inheritance starting.

If there is too much debt, you can choose to refuse everything, which is called “Renunciation of Inheritance” (Sozoku Hoki).

需要在继承发生后的3个月以内决定。

如果债务太多，可以选择全部放弃，这叫做“放弃继承（Souzoku Hoki）”。

• 全部もらう（財産も借金も） Accept All (Both assets and debts) 全部继承（包括债务）
• 全部断る（借金も払わなくていい） Refuse All (No need to pay debts) 全部放弃（不用还债）

ひとりで悩まないでください / Please do not worry alone / 请不要独自烦恼

相続は、お金・家族・法律が関係する難しい問題です。
